Help homecare workers gain minimum workplace protections

It’s hard to imagine that in 2012, millions of workers are still without minimum wage protections.  Even more shocking is that 2.5 million of these unprotected workers are those who provide critical care to the elderly and disabled in their homes.  Without minimum wage and overtime protections, the home care workforce suffers from low-wages, high turnover, stress and exhaustion.

In an effort to both improve these jobs and the quality of care provided, the Obama Administration has proposed a rule that would extend minimum wage and overtime protections to home care workers, who had long been considered exempt from the Fair Labor Standards Act (FLSA).

On top of being exempt from FLSA protections, the majority of home care workers are without the legally-protected right to form unions.  This is due to the fact that they either have no identifiable employer or they are misclassified by their employers as independent contractors.

Because the majority of home care workers lack the right to form unions, they are left at the mercy of whatever employment law protections may be on the books.  While 21 states and the District of Columbia already provide some minimum wage and overtime coverage for these workers, far too many are left with nothing.  Thus this proposed rule is essential to both improving the lives of millions of home care workers, as well as those they care for.  With a growing need for in-home care, this rule could ensure that there’s a more skilled workforce available to provide a higher quality of care.

Please demonstrate your support of this proposed rule and submit a simple comment to the Federal Register no later than March 12.

    When every Republican ran state is taking away bargaining rights, we need all the help we can get.

    All workers in this country, regardless of the type of job, deserve protection under the minimum wage and labor laws. Also, consider the fragility of those whom these home care workers take care of. Can we expect, at these wages and conditions, the best care possible for them?

    It is most needed for them because they work at the place which is not familiar with them hence its administration responsibility to provide them the protection.
